Overview

True Cinema · Greenville, South Carolina
Applies to all photo and video work by True Cinema, including TrueCinemaRealEstate.com, TrueCinemaEntertainment.com and TrueCinemaWeddingFilms.com.

Last updated: October 27, 2026

The short version: When you book True Cinema, you are buying a license to use the photos and videos we create, not the photos and videos themselves. True Cinema keeps the copyright. You get the right to use the media for the purpose you booked it for, and only that purpose. If you need more, ask us and we'll quote an expanded license.

1. Who these terms cover

"True Cinema," "we," and "us" mean True Cinema Entertainment LLC, doing business as True Cinema, and its owner, Max Gudakov. "You" and "Client" mean the person or business that books and pays for the work. "Media" means every photo, video, film, reel, drone image, 3D tour, floor plan, virtual staging image, audio, and any other material we create or deliver.

By booking, paying for, downloading, or using any Media, you agree to these terms. If a signed proposal, contract, or invoice says something different, that document controls for that project.

2. We own the copyright. This is not work-for-hire.

  • True Cinema is the author and sole owner of the copyright in all Media, from the moment it is created.
  • None of our work is "work made for hire." We are an independent business, not your employee, and no proposal, invoice, booking, or payment turns our work into work-for-hire or transfers copyright to you.
  • Copyright transfers only if both of us sign a separate written agreement that says so. Paying for a shoot, receiving files, or using the Media does not transfer ownership.
  • Any rights not clearly given to you in these terms stay with True Cinema.

3. Your license starts when you pay in full

You receive a limited, non-exclusive, non-transferable, non-sublicensable license to use the Media as described in Section 4. This license starts only when we receive full payment. Until then, you may not use the Media anywhere, including the MLS. If a payment is reversed, charged back, or left unpaid, the license ends and the Media must be taken down.

4. What your license covers, by type of work

Real estate listing media

(Listing photo and video packages and all listing add-ons: twilight, Matterport, aerial, vertical video, virtual staging, interior-only photos)

Photos and video may be used to market this listing until the property sells or for one year, whichever comes first. Social media posts may stay up. Media may not be transferred to anyone without the photographer's permission. If your broker requires a full copyright release or a perpetual license, contact us, as that increases the cost.

Rental and vacation-rental media

(Airbnb photos, apartment complex shoots)

Media is licensed for rental or vacation rental marketing only, for as long as you own or manage the property. It may not be transferred, sold, or used for any other purpose.

Commercial media

(Commercial photography and commercial video)

Media is licensed to your person or business for its own marketing. It may not be transferred to another person or business except by the photographer.

Agent brand media

(Agent brand films, brand retainers, custom YouTube videos, podcast episodes)

Media is licensed to you for your personal brand marketing, including your website, social media, ads, and listing presentations, with no time limit. It may not be transferred, resold, or used by another agent or company without the photographer's permission.

Wedding and personal films

Wedding films, photos, and other personal-event Media are licensed for your personal, non-commercial use. You're welcome to share them on your personal social media, with family and friends, and to make personal prints and copies. You may not sell them, license them, or use them in advertising, including by vendors, venues, or planners, without our written permission.

Custom, brand, and other projects

For custom and brand projects, the license (how, where, and for how long you may use the Media) is set by your proposal or invoice. If the proposal or invoice doesn't say, the Commercial license above applies.

5. MLS, listing websites, and your brokerage

For listing media:

  • MLS and listing sites. You may upload the Media to your MLS and let it syndicate to listing websites such as Zillow, Realtor.com, Redfin, and Homes.com, and post it on your own website and social media, to market the listing.
  • What the MLS requires. Many MLSs require the listing agent to give the MLS a broad license to store, display, and share listing media as part of its database (for example, for archived listings, comparable sales, and appraisals). We allow you to give your MLS the license its rules require, for those MLS purposes only. That permission does not let you, any listing site, or anyone else use the Media for other purposes.
  • Co-listing agents and your brokerage. A co-listing agent named on the same listing, and your brokerage, may use the Media only to market that same listing during the license period. They may not use it for other listings, brokerage or recruiting ads, or general branding without a separate license.
  • If the listing changes hands. If the listing moves to a new agent or brokerage, or is re-listed after it expires or is withdrawn, the original license does not go with it. The new agent needs their own license.

6. No transfers to anyone else

Your license is for you only. You may not give, sell, lend, or sublicense the Media to anyone else, including:

  • builders or developers
  • sellers, buyers, or landlords
  • stagers, interior designers, architects, or contractors
  • other agents, teams, or new listing agents
  • vendors, venues, magazines, or publishers

Anyone who wants to use the Media needs their own license from us. It's easy to request: contact us through our Contact page with the property address or project name, who wants to use it, and how and where they plan to use it. We'll reply with a quote.

7. How you may not use or change the Media

Unless we agree in writing, you may not:

  • edit, retouch, filter, re-color, or combine the Media with other images (normal resizing and cropping to fit a website, MLS, or social media format is fine)
  • re-edit, cut down, or re-score our videos
  • remove or cover any watermark, logo, credit, or copyright information
  • use the Media in contests, awards, editorial, or publications
  • use the Media to market a different property, product, or business
  • use the Media to train, fine-tune, or feed any artificial intelligence or machine-learning system, or to create AI-generated or "look-alike" content
  • claim the Media as your own work or register it with any copyright office or stock agency

8. Our right to use the work

We may use any Media we create in our portfolio, website, social media, advertising, award entries, and other marketing for True Cinema. If you'd rather we not share your project publicly (for example, for privacy or security reasons), we'll keep it out of our public marketing on request. Just let us know in writing.

9. What we deliver

We deliver finished, edited Media only. Raw files, unedited footage, outtakes, and project files are never delivered, sold, or licensed, under any package.

Please download and back up your files when delivered.

10. Music in videos

Music in our videos is licensed from third-party music libraries for that specific video. The music license covers only the original video as we delivered it. You may not take the music out and use it elsewhere, put it in a different video, or re-edit the video with it. Some platforms may still flag licensed music; if that happens, contact us and we'll help clear it.

11. Unauthorized use

Using the Media outside your license, including after the license ends, is copyright infringement. If it happens:

  • License fee. We will invoice a retroactive license fee of three times (3×) our standard fee for that use. Paying it does not waive our other rights.
  • Takedown. We may ask you, any website, or any platform to remove the Media, including by DMCA takedown notice.
  • Legal action. We reserve all rights and remedies under U.S. copyright law, including damages and attorney's fees where allowed.

12. Property access and permissions

You are responsible for having permission to photograph or film the property, people, and anything else at the shoot. That includes getting the owner's or seller's permission (if you're not the owner), arranging access, and letting occupants and tenants know. You agree that True Cinema isn't responsible for claims that come from missing permissions. If people appear on camera, you're responsible for any releases your use needs unless we agree to handle them.

Drone flights are subject to FAA rules, airspace limits, and weather, and we may decline or reschedule a flight for safety or legal reasons.

13. Cancellations

Your shoot date and time are reserved once your order is paid in full.

  • 24 hours or more before your shoot: if you cancel, you get a full credit for the amount you paid, which you can use toward a future shoot.
  • Less than 24 hours before your shoot: if you cancel, you get a credit for 50% of the amount you paid, which you can use toward a future shoot.

Credits are not refunds and must be used within one year of the date you cancel. To cancel, contact us by phone or email.

14. Governing law

These terms are governed by the laws of the State of South Carolina and applicable U.S. federal law, including the Copyright Act. Any dispute will be handled in the state or federal courts serving Greenville County, South Carolina.

15. Changes to these terms

We may update these terms from time to time. The version posted on this page when you book applies to that booking. Changes don't reduce rights you've already paid for.
